Are cannabis seeds legal in Spain?
Seeds are not a controlled substance
The 1961 UN Single Convention on Narcotic Drugs excludes seeds from its definition of cannabis, and Spanish law follows it. Seeds contain no THC, so buying, selling and owning them is legal. Spain is home to many of Europe's best-known seed banks.
Growing at home
Growing cannabis for personal use in a private space is not a criminal offence in Spain. Plants visible from the street, a balcony or a terrace are a serious administrative offence under Organic Law 4/2015 (article 36.18), with fines from €601 to €30,000.
Selling cannabis is still a crime
Selling cannabis flowers or extracts remains a criminal offence under article 368 of the Criminal Code. This is why responsible seed companies sell seeds as collectible souvenirs and do not give growing instructions.
Cannabis social clubs
Non-profit cannabis associations operate in several regions, mostly in Catalonia and the Basque Country. Their legal status depends on the region and on court rulings, and remains a grey area.
Medical cannabis
Royal Decree 903/2025 of 7 October 2025 regulates standardised cannabis preparations made and dispensed through hospital pharmacies. It does not change the rules for seeds or home growing.

Selling seeds in Spain
Spain has a large network of grow shops and seed banks, and it hosts Spannabis in Barcelona, one of the trade fairs where we exhibit.
Grow shops tend to mix feminized and autoflowering lines. Outdoor-heavy regions with long seasons also ask for triploid genetics, whose seedless flowers are protected from stray pollen.
Many Spanish brands start their own seed bank with our private label service and custom mylar bags.
